These Terms of Service ("Terms") govern your access to and use of jokerine.com (the "Site") and your purchase of a personalized song (the "Service"). The Service is provided by MERDAS ENKEL LIV (org. no. 938 195 307), operating as JOKERINE.
By using the Site or purchasing the Service, you agree to these Terms. If you do not agree, please do not use the Service.
JOKERINE creates a personalized song based on the story, name and details you provide at checkout. The song is delivered to you digitally by email (as an audio file) or by a download link.
Orders are placed through our checkout and processed securely by our payment provider, Stripe. Prices are shown at checkout in the stated currency (currently USD). By placing an order, you confirm that the payment information you provide is accurate and that you are authorized to use it.
You are responsible for the information and text you submit to personalize your song. You agree not to submit content that is unlawful, harmful, threatening, defamatory, or that infringes the rights of any third party. We may refuse or cancel an order if the submitted content violates these Terms.
The song is delivered digitally after we have produced it. Production time is stated at the time of purchase or communicated by email. Delivery is made to the email address you provide at checkout, so please ensure it is correct.
The Service is customized, personalized digital content that is produced and delivered immediately for you. Under consumer law, a right of withdrawal does not apply to digital content that is delivered with your express consent. By placing an order, you acknowledge and consent that the personalized song will be produced immediately and that, once delivered, you lose your right of withdrawal.
Upon delivery of a completed song, we grant you a personal, non-exclusive, non-transferable license to use the song for personal, non-commercial purposes. You may not resell, sublicense, redistribute or use the song for commercial purposes without our prior written consent. We retain all intellectual property rights in the song.
Because the song is personalized and delivered digitally, we generally do not offer refunds after delivery. If there is a defect or error in your order (for example, a wrong name or a corrupted file), contact us within 14 days of delivery and we will correct it or offer a refund at our reasonable discretion. Payment disputes should first be raised with us at hebalauder@gmail.com before contacting your payment provider.
The Service is provided "as is". To the fullest extent permitted by law, our total liability arising out of or in connection with the Service is limited to the amount you paid for the order. We are not liable for indirect, incidental or consequential damages. Nothing in these Terms limits your statutory rights as a consumer that cannot be limited by law.
These Terms are governed by Norwegian law. Any disputes shall be subject to the jurisdiction of the Norwegian courts, without prejudice to any mandatory consumer protection rules that may apply in your country of residence.
We may update these Terms from time to time. The version in effect at the time of your order applies to that order.
